Website & Platform Terms of Use

About these Terms

These Terms of Use apply to your access to and use of the TKTDIG website, ticketing platform and related online services.


TKTDIG Pty Ltd is referred to in these Terms as "TKTDIG", "we", "us" or "our".


By accessing or using the TKTDIG website or platform, you agree to these Terms of Use, our Privacy Policy and, where applicable, our Terms of Purchase.



1. TKTDIG's Role


TKTDIG provides ticketing technology and related services that enable Event Organisers to advertise Events, issue and manage tickets, process bookings and communicate with ticket purchasers.


Unless expressly stated otherwise, TKTDIG is not the promoter, producer, performer or venue operator of an Event.


The relevant Event Organiser is responsible for the production, operation and delivery of its Event, including Event content, scheduling, pricing, seating configuration and Event-specific customer obligations, subject to applicable law.


2. Event Organisers


Events displayed through TKTDIG are created and managed by independent Event Organisers.


Event Organisers are responsible for ensuring that information they provide about their Events is accurate and lawful.


TKTDIG may provide technical and administrative assistance to an Event Organiser, but doing so does not make TKTDIG the producer or promoter of the Event.


3. Accounts and Information


You must provide accurate and current information when creating an account, purchasing tickets or otherwise using the platform.


You are responsible for maintaining the security of your account and login credentials.


You must notify TKTDIG promptly if you reasonably believe your account has been accessed or used without authorisation.


TKTDIG may suspend or restrict an account where reasonably necessary to investigate suspected fraud, misuse, security concerns or unlawful activity.


4. Customer Data and Personal Information


Our Data Principle

TKTDIG recognises that customer information must be handled transparently and responsibly.


Personal information is not treated by TKTDIG as property that TKTDIG may freely sell or transfer.



When you purchase a ticket or interact with an Event through TKTDIG, information relevant to that transaction may be collected by TKTDIG and made available to the relevant Event Organiser where reasonably necessary to:



  • process and administer your booking;

  • issue and validate tickets;

  • operate and manage the Event;

  • provide customer support;

  • communicate Event information, changes or important notices;

  • manage entry, seating, refunds or other Event-related matters;

  • prevent or investigate fraud or misuse; and

  • comply with legal obligations.


The relevant Event Organiser may therefore have access to information associated with bookings for its Event.


TKTDIG and Event Organisers must handle personal information in accordance with applicable privacy laws and their respective legal obligations.

5. Marketing


Purchasing a ticket does not automatically constitute consent to receive unrelated promotional marketing.

TKTDIG or an Event Organiser may send communications reasonably necessary for the administration or delivery of an Event you have booked.


Promotional or marketing communications will be handled in accordance with applicable law and any consent or communication preferences provided by you.


Where an Event Organiser receives customer information through TKTDIG, the Event Organiser must not use that information for unrelated marketing merely because the customer purchased a ticket, unless it has an appropriate lawful basis or the customer has provided the necessary consent.


6. Event Organiser Content and Data


Event Organisers retain their rights in the Event information, branding, images, descriptions and other content they provide to TKTDIG.


TKTDIG does not acquire ownership of an Event Organiser's underlying business merely because the Event Organiser uses the TKTDIG platform.


Event-specific booking and transaction information may be made available to the relevant Event Organiser for legitimate purposes connected with its Event and its legal obligations.


Nothing in these Terms transfers ownership of TKTDIG's platform technology, intellectual property or proprietary systems to an Event Organiser.


7. TKTDIG Platform and Intellectual Property


TKTDIG retains all rights it owns in the TKTDIG brand, platform, website, interfaces, business processes, documentation, system configurations, designs, software and other proprietary materials.


Certain technology used to provide the current TKTDIG service may be supplied or licensed by third-party technology providers. Those providers retain ownership of their respective intellectual property.


You must not, without permission:



  • copy or reproduce protected TKTDIG material;

  • attempt to gain unauthorised access to the platform;

  • interfere with platform security;

  • reverse engineer technology except where expressly permitted by law;

  • use TKTDIG trademarks or branding without authorisation; or

  • use the platform for unlawful or fraudulent purposes.


8. Platform and Analytical Data


TKTDIG may generate operational, technical, security and analytical information through operation of the platform.


TKTDIG may use aggregated or de-identified information to operate, secure, analyse and improve its services, develop platform functionality and understand ticketing and Event performance, provided that such use complies with applicable law.


Nothing in this clause permits TKTDIG to sell identifiable customer personal information as an unrestricted commercial asset.


9. Payments


Ticket payments are processed through approved payment-service providers.


Where an Event Organiser operates its own payment gateway, ticket proceeds may be processed and settled through that Organiser's payment arrangements.


In limited circumstances, TKTDIG may provide temporary or alternative payment-processing arrangements for an Event Organiser.


TKTDIG does not require customers' complete payment-card credentials to be stored within the TKTDIG ticketing database where those credentials are handled by the relevant payment provider.


Specific payment, refund and ticket-purchase conditions are contained in the TKTDIG Terms of Purchase.


10. Overseas Technology and Data Processing


TKTDIG may use technology, hosting, ticketing, payment or other service providers located outside Australia.


Accordingly, personal information may be processed, stored or accessible outside Australia, including in the United States.


TKTDIG's Privacy Policy provides further information about overseas processing and disclosure.


Where applicable, TKTDIG will take reasonable steps required by Australian privacy law in relation to overseas handling of personal information.


11. Security


TKTDIG takes reasonable steps appropriate to its role to protect information and platform access from misuse, interference, loss and unauthorised access, modification or disclosure.


No online service can guarantee absolute security or uninterrupted availability.


Users must take reasonable precautions to protect their own account credentials and devices.


If TKTDIG becomes aware of a suspected data or security incident, it may investigate, contain and remediate the incident and make notifications where required by applicable law.


12. Acceptable Use


You must not use TKTDIG to:



  • commit or facilitate unlawful or fraudulent activity;

  • interfere with the operation or security of the platform;

  • introduce malicious code;

  • obtain unauthorised access to accounts or data;

  • impersonate another person;

  • submit deliberately false or misleading information;

  • infringe another person's intellectual property rights;

  • harass or threaten another person; or

  • use automated systems to interfere with ticket availability or purchasing controls.


TKTDIG may take reasonable action, including restricting or suspending access, where it reasonably believes these Terms have been breached.


13. Third-Party Services


TKTDIG may rely on third-party providers for ticketing infrastructure, hosting, payment processing, communications and other technology.


Third-party services may be subject to their own terms and policies.


TKTDIG is not responsible for matters exclusively within the control of an independent third-party provider, except to the extent responsibility cannot lawfully be excluded.


14. Availability and Changes


TKTDIG aims to provide reliable access to its services but does not guarantee that the platform will always be uninterrupted or error-free.


Maintenance, telecommunications failures, payment-provider outages, cyber incidents and circumstances outside TKTDIG's reasonable control may occasionally affect availability.


TKTDIG may modify or improve the platform from time to time.


15. Australian Consumer Law


Your statutory rights are protected.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.



Where TKTDIG is legally entitled to limit a liability, any limitation will operate only to the extent permitted by law.


16. Events and Event Organiser Responsibility


TKTDIG is not responsible for an Event Organiser's independent decisions concerning performers, Event content, production, venue operation, Event scheduling or Event cancellation, except to the extent TKTDIG is independently responsible under applicable law.


Ticket-purchase, Event-change and refund provisions are dealt with in the TKTDIG Terms of Purchase and any applicable Event-specific conditions.


17. Suspension and Termination


TKTDIG may reasonably suspend or restrict access to the platform where necessary for:



  • security;

  • suspected fraud;

  • breach of these Terms;

  • unlawful activity;

  • protection of customers or Event Organisers;

  • compliance with law; or

  • protection of the integrity of the ticketing platform.


Where reasonably practicable, TKTDIG will take proportionate action having regard to the circumstances.


18. Changes to These Terms


TKTDIG may update these Terms from time to time to reflect changes to the platform, business operations or applicable law.


The current version will be published on the TKTDIG website together with its effective date.


Changes will not retrospectively remove rights that have already arisen under applicable law.


19. Governing Law


These Terms are governed by the laws of New South Wales, Australia.


Nothing in this clause limits any right a consumer may have to bring a claim in another jurisdiction where applicable law provides that right.
